Tucker, GA — Tucker City Council members met on Jan. 10, one day before the three new councilmembers were to be sworn in, for a specially called closed-door meeting.

The sole purpose of the closed-door meeting, known as an executive session, was to discuss litigation, according to the agenda that appeared minutes before the meeting began. Under Georgia law, executive sessions are legal for specific purposes, including discussions of ongoing or pending litigation.

After meeting nearly two and a half hours, the meeting was adjourned. The City Council did not take any action.

Council members Anne Lerner, Michelle Penkava, Pat Soltys and Matt Robbins were in person at the Jan. 10 meeting, joined virtually by Virginia Reece, Noelle Monferdini and Mayor Frank Auman.

Incoming council members Roger Orlando, Cara Schroeder and Alexis Weaver were not included in the special called meeting because they have not been sworn in according to Matt Holmes, Tucker Director of Communications and Operations.

“Councilmembers-elect Orlando, Schroeder and Weaver will all be sworn in tomorrow night, at which point they will be able to participate in executive sessions,” Holmes said.

He said the council members-elect will be briefed on what was discussed in executive session after they are sworn in.

“The new council members are in the process of being briefed on all business before the city,” Holmes said. “Confidential matters that would be discussed in executive session will have to wait until after they are sworn in tomorrow.”
